Your privacy is important to BLOU INK; we respect your privacy and want to protect your personal information.  This Privacy Policy is prepared to describe to you BLOU INK’s practices regarding the personal information (as defined below) collected from users of our Site at www.blouink.com and Services (as defined in the Terms of Use).  It also describes the choices available to you regarding the use of your personal information and how you can access and update this information.  We reserve the right to change this policy, which we'll do through online posting. We are very careful with what we do with your information.  To learn more, please read this privacy policy.

 

We will not disclose your personally identifiable information to third parties for their marketing purposes without your consent.

This Privacy Policy explains how we collect, use and (under certain conditions) disclose your personal information. It also explains the steps we have taken to secure your personal information. Finally, it explains your options regarding the collection, use and disclosure of your personal information. By visiting our Site, you accept the practices described in this Policy and in our Terms of Use .

This privacy policy applies only to this Site. We are not responsible for the content or privacy practices on any non-BLOU INK website to which this Site links or that links to this Site.

 

1. User Consent.

By submitting Personal Information through our Site or Services, you expressly consent to the collection, use and disclosure of your Personal Information in accordance with this Privacy Policy.

 

2. Visitors under the age of 13.

We respect children's privacy. We do not knowingly or intentionally collect personal information from children under age 13. Elsewhere on this Site, you have represented and warranted that you are either 18 years of age or using the Site with the supervision of a parent or guardian. If you are under the age of 13, please do not submit any personal information to us, and rely on a parent or guardian to assist you.

 

3. Types of Data We Collect

We collect information from you in several different ways on this Site. One goal in collecting personal information from you is to provide an efficient, meaningful, and customized experience. For example, we can use your personal information to:

  • help make this Site easier for you to use by not having to enter information more than once.

  • help you quickly find information, products, and services.

  • help us create content on this Site that is most relevant to you.

  • alert you to new information, products, and services that we offer.

 

“Personal Information” means data that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, as well as any other non-public information about you that is associated with or linked to any of the foregoing data. “Anonymous Data” means data that is not associated with or linked to your Personal Information; Anonymous Data does not, by itself, permit the identification of individual persons. We collect Personal Information and Anonymous Data, as described below.

 

  1. Information You Provide to Us.

Registration and Ordering. 

Before using certain parts of this Site or ordering products, you must complete an online registration form. During registration, you will be prompted to provide to us certain personal information, including but not limited to your name, shipping and billing address(es), phone number, email address, PayPal or credit card number. In addition, we may also ask you for your country of residence, so we can comply with applicable laws and regulations, and for your gender. These kinds of personal information are used for billing purposes, to fulfill your orders, to communicate with you about your order and our site, and for internal marketing purposes. If we encounter a problem when processing your order, we use the personal information to contact you.

  • We may collect Personal Information from you, such as your name, e-mail and mailing addresses, phone number, and password when you create an account with us (“Account”).

  • If you are a Designer, we may require that you provide your tax information (e.g., social security number).

  • When you make a purchase, we (or our third party service provider) will collect all information necessary to complete the transaction, including your name, credit card information, debit card information, billing information and/or PayPal information.

  • We retain information on your behalf, such as Design Briefs, Design Projects, Design Concepts, Portfolio Items, e-Décor Packages, Invoice Service invoices, transactional history, messages and any other information that you store using your Account.

  • Several locations of the Site permit you to enter your email address for purposes including but not limited to:  to register for promotions; to request us to notify you when regarding particular offers or products, or to sign up for our email newsletter and special offers, including contests, which we may run from time to time.  Your participation in a contest is completely voluntary, so you have a choice whether to participate and disclose information to us.  We use this information to notify contest winners and to award prizes.  We may post on our site the names and cities of contest winners. 

If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply.

  • When you participate in one of our surveys, we may collect additional profile information.

  • When you post messages on our Site, the information contained in your posting will be stored on our servers and other users will be able to see it.

  • We may also collect Personal Information at other points in our Site that state that Personal Information is being collected.

 

 

  1. Information Collected via Technology.

Like many sites, this Site employs cookies and web beacons (also known as clear GIF technology or "action tags") to speed your navigation of the Site, recognize you and your access privileges, and track your Site usage.

  • To make our Site and Services more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit. We use this information, which does not identify individual users, to analyze trends, to administer the Site, to track users’ movements around the Site and to gather demographic information about our user base as a whole. We may link this automatically-collected data to Personal Information for the purposes of security and to detect fraudulent activity.

  • We also use cookies and URL information to gather information regarding the date and time of your visit and the information for which you searched and which you viewed. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. Persistent Cookies can be removed by following Internet browser help file directions. Cookies may enable automatic logins when you visit in the future and may enable content customization.

  • We also employ a software technology called clear gifs (a.k.a. Web Beacons), that help us better manage content on our Site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on web pages and are about the size of the period at the end of this sentence. We may tie the information gathered by clear gifs to our visitor’s Personal Information.

  • We may use third-party advertising companies to help us tailor site content to users or to serve ads on our behalf. These companies may employ cookies and web beacons to measure advertising effectiveness (such as which web pages are visited or what products are purchased and in what amount). Any information that these third parties collect via cookies and web beacons is not linked to any personal information collected by us.

  • The use of tracking technologies by our technology partners and other 3rd party assets on the Site is not covered by our Privacy Policy. These 3rd parties may use cookies, clear gifs, images, and scripts to help them better manage content on our Site. We do not have access or control over these technologies. We do not tie the information gathered to our visitor’s Personal Information. We partner with a third party ad network to manage our advertising on other sites. Our ad network partner uses cookies and Web beacons to collect non-personally identifiable information about your activities on this and other websites to provide you targeted advertising based upon your interests.

 

c. Google Analytics.

We currently use Google Analytics as well as Google Analytics for Display Advertising. Google Analytics collects information anonymously and reports website trends without identifying individual visitors. Google Analytics uses its own cookie to track visitor interactions. Website owners can view a variety of reports about how visitors interact with their website so they can improve their website and how people find it. You can also opt-out of Google Analytics for Display Advertising by going to the Google Ads Preferences Manager.

 

4. Use of Your Personal Information

a. General Use.

In general, Personal Information you submit to us is used either to respond to requests that you make, or to aid us in serving you better. We use your Personal Information in the following ways:

  • to facilitate the creation of and secure your Account;

  • identify you as a user in our system;

  • improve our Site and Services;

  • for our internal research and development;

  • customize content to match your preferences;

  • prevent suspended users from re-registering;

  • provide the Services you request;

  • send you a welcome e-mail to verify ownership of the e-mail address provided when your Account was created;

  • send you administrative e-mail notifications, such as security or support and maintenance advisories;

  • respond to your inquiries and requests;

  • to make telephone calls to you, from time to time, as a part of secondary fraud protection or to solicit your feedback; and

  • to send newsletters, surveys, offers, and other promotional materials related to our Services and for other marketing purposes of BLOU INK.

 

b. Creation of Anonymous Data.

We may create Anonymous Data records from Personal Information by excluding information (such as your name) that make the data personally identifiable to you. We use this Anonymous Data to analyze request and usage patterns so that we may enhance the content of our Services and improve Site navigation. BLOU INK reserves the right to use Anonymous Data for any purpose and disclose Anonymous Data to third parties in its sole discretion.

 

5. Disclosure of Your Personal Information.

We disclose your Personal Information as described below and as described elsewhere in this Privacy Policy.

a. Profile Information.

The profile you create on our Site will be publicly accessible unless otherwise indicated. You may delete your profile by requesting to delete your account by contacting us via email at hello@blouink.com. The information collected during the registration process by BLOU INK may be used by BLOU INK to: contact members, customize content to match your preferences, display member status, and display the date of a member’s last visit

b. Third Party Service Providers.

We may share your Personal Information with third party service providers to: provide you with the Services that we offer you through our Site; to conduct quality assurance testing; to facilitate the creation of accounts; to provide technical support; and/or to provide other services to BLOU INK. These third party service providers are required not to use your Personal Information other than to provide the services requested by BLOU INK.

c. Affiliates and Acquisitions.

We may share some or all of your Personal Information with our parent company, subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy. If another company acquires our company, business, or our assets, that company will possess the Personal Information collected by us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy. You will be notified via email and/or a prominent notice on our Site of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.

d. Other Disclosures.

Regardless of any choices you make regarding your Personal Information (as described below), BLOU INK may disclose Personal Information if it believes in good faith that such disclosure is necessary (a) in connection with any legal investigation; (b) to comply with relevant laws or to respond to subpoenas or warrants served on BLOU INK; (c) to protect or defend the rights or property of BLOU INK or users of the Services; and/or (d) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or the Terms of Use.

 

6. Third Party Websites.

a. Third Party Sites Generally.

When you click on a link to any other website or location, you will leave our Site and go to another site and another entity may collect Personal Information or Anonymous Data from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites.

b. Social Networking Sites.

If you (i) log on to the Service with your login credentials from a social networking site (such as Facebook, Twitter, or LinkedIn) (“Social Networking Site”) or (ii) associate your Account with your account at a Social Networking Site, we may receive information about you from such Social Networking Site, in accordance with such Social Networking Site’s terms of use and privacy policy (“SNS Terms”). We may add this information to the information we have already collected from you via the Service. If you elect to share your information with these Social Networking Sites, we will share information with them in accordance with your election. The SNS Terms will apply to the information we disclose to them.

c. Other Social Media Features.

Our Site includes social media features (“Features”) such as the Facebook Like button, Tweet button and other widgets or interactive mini-programs that run on our Site. These Features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the Feature to function properly. These Features are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the terms of use and privacy policy of the company providing them (e.g., Facebook or Twitter).

 

7. Your Choices Regarding Your Personal Information

a. Choices.

We offer you choices regarding the collection, use, and sharing of your Personal Information.

  • When you create an Account on www.blouink.com, we may periodically send you free newsletters and e-mails that directly promote the use of our Site or Services. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive, by adjusting your email preferences from within your Account setting page or by contacting us directly (please see contact information below).

  • Despite your indicated e-mail preferences, we may send you service related communication, including notices of any updates to our Terms of Use or Privacy Policy.

b. Changes to Personal Information.

You may change any of your Personal Information in your Account by editing your profile within your Account or contacting us via the Site. You may request deletion of your Personal Information by contacting us via the site or at hello@blouink.com , but please note that we may be required to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives.

We will retain your information for as long as your Account is active or as needed to provide you Services, for fraud prevention and similar purposes and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

 

8. Security of Your Personal Information.

We do not sell, rent, trade, license or otherwise disclose your specific personal information or financial information to anyone, except that:

  • As do most Internet retailers, we sometimes use others to perform specific functions on our behalf. When we disclose information to these service providers, we disclose information to help them to perform their service. For example, in order to deliver products to you, we must share some information. We partner with third parties (such as the U.S. Postal Service, United Parcel Service, and Federal Express) to ship products, to ensure delivery, and so that we can obtain feedback, improve the quality of our service, and measure and improve the quality of the service of the third party. In the example of shippers, we provide them some personally identifiable information such as your name, shipping address, email, and phone number.

  • Similarly, to help you buy products and provide Client Services to you, we must provide your credit card number to financial services corporations such as credit card processors and issuers. When we submit your credit card number for authorization, we use state-of-the-art data encryption to protect your information. (More on this below in Data Security.)

  • We may be required to disclose such information in response to requests from law-enforcement officials conducting investigations; subpoenas; a court order; or if we are otherwise required to disclose such information by law. We also will release personal information where disclosure is necessary to protect our legal rights, enforce our Terms of Use or other agreements, or to protect ourselves or others. For example, we may share information to reduce the risk of fraud or if someone uses or attempts to use our Site for illegal reasons or to commit fraud.

  • We will not sell (or trade or rent) personally identifiable information to other companies as part of our regular course of business. However, it's possible that we might acquire or merge with or be acquired by another company or that we might dispose of some or all of our assets. If that happens, your personal information may be disclosed to another company, but that disclosure will be subject to the Privacy Policy in effect.

  • We may share non-personal information (such as the number of daily visitors to a particular web page, or the size of an order placed on a certain date) with third parties such as advertising partners. This information does not directly personally identify you or any user.

 

BLOU INK is committed to protecting the security of your Personal Information. We (and our third party service providers) use a variety of industry-standard security technologies and procedures to help protect your Personal Information from unauthorized access, use, or disclosure. When you enter sensitive information (such as a credit card number or SS#) on our order forms, we (or our third party service providers) encrypt the transmission of that information using secure socket layer technology (SSL). We also require you to enter a password to access your Account information. Please do not disclose your Account password to unauthorized people. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while BLOU INK uses reasonable efforts to protect your Personal Information, BLOU INK cannot guarantee its absolute security. In the unlikely event that we believe that the security of your personal information in our possession or control may have been compromised, we may seek to notify you of that development. If a notification is appropriate, we would endeavor to do so as promptly as possible under the circumstances, and, to the extent we have your email address, we may notify you by email.

 

9.  OPT OUT/CORRECTIONS

On your request, we will (a) correct or update your personal information; (b) stop sending certain non-membership or order-related emails to your email address; and/or (c) disable your account to prevent any future purchases through that account. You can make these requests by emailing your request to our Client Services department at hello@blouink.com.  Please do not email your credit card number or other sensitive information.

 

10. Blogs

Our Site offers publicly accessible blogs. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your Personal Information from our blog or community forum, contact us at info@blouink.com. In some cases, we may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so and why.

 

11. Testimonials

We display personal testimonials of satisfied customers on our Site in addition to other endorsements. If you choose to provide a testimonial on the Site, we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at hello@blouink.com.

 

12. Referrals

If you choose to use our referral service to tell a friend about our Site, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Site BLOU INK stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program. Your friend may contact us to request that we remove this information from our database.

If you've been contacted by BLOU INK, we may have received your information in a few different ways. First, a friend may have referred you. Visitors of the Site may give us your name and email address in order for them to customize an invitation for you to join. You also may receive similarly customized email reminders from your friend about this invitation. If you apply for membership, your information will be used in accordance with the rest of this privacy policy. If you choose not to apply online, your email address may be retained for a period. Similarly, a member may have shipped a gift or other merchandise to you through us and provided your personal information for that purpose.

You may have received an offer from us. If you were a prior member, we may have invited you back. We may also have received your information from one of our partners or from the mailing, opt-in emailing, or phone lists of a reputable company. Unless we are using an opt-in only list in our marketing efforts, BLOU INK will screen our lists with the Direct Marketing Association preference lists before we send such offers.
